Strike 3 Holdings FAQ

What is a Strike 3 Holdings ISP letter?

It is usually a notice from your internet provider that a federal court has allowed Strike 3 Holdings to subpoena the name and address of the account holder linked to an IP address in a copyright lawsuit. The provider sends the notice before it responds to the subpoena. How ISP subpoena orders work.

Is the letter real, or is it a scam?

Genuine notices come from your internet provider and refer to a federal case number and court. These are real federal copyright lawsuits. If anything about the letter seems unusual, an attorney can confirm the case for you before you respond to anyone.

Does the letter mean I have been sued by name?

Usually not. The lawsuit is typically filed against “John Doe,” identified only by an IP address. The subpoena asks the provider to identify the account holder. A later document, such as an amended complaint, is what would name a person.

Does Strike 3 Holdings already know my name?

Generally not at this stage. The provider knows who the account holder is, and the subpoena is how Strike 3 Holdings asks for that information. That is why many people talk with an attorney while they are still anonymous. How they get a name.

How did they connect an IP address to my internet account?

Strike 3 Holdings alleges that its films were shared over BitTorrent from a specific IP address at specific times. An IP address points to an internet provider, and the provider can match it to an account. It does not, by itself, show who was using the connection. IP addresses and names.

I did not download anything. Why did I get this letter?

The letter goes to the account holder, who is not always the person who used the connection. Several judges have noted that the bill-payer may be a family member, a roommate, a guest, a neighbor or someone else. Who had access to your network, and how your router and Wi-Fi are set up, can matter. Risk of false positive identifications.

What should I do first?

Read the whole letter calmly. Write down the full case number, the court and courthouse location, the IP address, and the dates the letter gives. Keep every document as it is. Then email or upload your documents for a free confidential review.

What should I avoid doing?

Do not contact Strike 3 Holdings or its attorneys yourself, do not sign anything, and do not delete files or wipe devices. Avoid discussing your case on forums or social media. Do not file anything in court on your own without advice, because a filing you make yourself can put your name in the public record. Why filing your own motion can affect your privacy.

Is there a deadline?

Each court and judge sets its own timeline for objections and for when the provider responds, and the letter usually states the relevant dates. Use the dates on your own letter, not dates from another person’s letter or another court. Deadlines depend on the court.

What is a motion to quash?

A motion to quash asks the court to cancel or limit the subpoena to your internet provider. It can be the right step in some cases and not in others. It is different from asking the court to let you proceed anonymously. Motions to quash.

Can I keep my name private?

Many people resolve these cases confidentially through counsel, often without their name appearing in the public court record. Some courts also allow defendants to proceed anonymously at certain stages. Privacy depends on the court and the facts, and no one can promise a result.

What does settling involve?

A settlement is a negotiated agreement. Terms are worked out case by case and handled through your attorney, and agreements can include confidentiality terms. An attorney can explain the pros and cons for your situation. Pros and cons of settling.

Can I fight the case in court?

Yes. If the facts support it, a case can be defended in federal court. There are real costs and risks on both sides, and an attorney can walk you through them. Antonelli Law® defends Strike 3 Holdings cases in court when that is the right path. Strike 3 Holdings defense.

What if I received an amended complaint or a waiver of service form?

That is a later stage than the first ISP letter. An amended complaint can name a person, and a waiver of service request asks the defendant to waive formal service of a summons. You can email or upload these documents for review as well. What the later stage means.

Do you handle cases outside Illinois?

Yes. Strike 3 Holdings cases are filed in federal courts, and Antonelli Law® handles them for clients across the country, working with local counsel where a court requires it.

Is the consultation free and confidential?

Yes. The initial consultation is free and confidential. Requesting one does not commit you to anything, and it is not a decision to go to court.

What documents should I send?

The ISP letter or email (all pages), any court order or subpoena that came with it, any letter from the plaintiff’s attorneys, and any later document such as an amended complaint or waiver of service form. Don’t sign a waiver of service form without advice from an attorney experienced in litigation. Email or upload these documents through our contact page

great experience with Antonelli

“I hired Jeffrey Antonelli for a copyright infringement issue (Strike3) in Massachusetts. It was a very good decision. He has dealt with many such cases and immediately put me at ease. He ended up negotiating a settlement that was much less than what I told him was my limit. He understood my privacy concerns and ensured that my name stayed out of any communication with opposing counsel, court filings etc. The whole issue was wrapped up within 3 weeks. He charges a non-negligible fee, but it is 100% worth it if you want to settle quickly and quietly and move on.”
