Arizona – UN4 Productions represented in Arizona by attorney Gregory Collins:

In general, these cases have been very slow to start but we expect them to proceed fairly quickly now in the last months of the year. Antonelli Law has represented many Arizonans in cases similar to these filed by UN4 Productions and look forward to possibly combining a visit to the courthouse and to our family land near Tucson this winter.

Several cases were filed by UN4 Productions in Arizona federal court in July, but none have proceeded in substance until very recently.

On August 25ththe motion filed by UN4 Productions to consolidate its multiple cases was DENIED by Judge David G Campbell. Cases affected are:

  • 2:17-cv-02164-DGC
  • 2:17-cv-02168-DLR
  • 2:17-cv-02169-DGC
  • 2:17-cv-02170-DJH

In addition, several judges appear to have delayed their orders in response to the movie company’s requests for allowing subpoenas to issue against internet companies to reveal the names and addresses of internet subscribers whose IP addresses were allegedly associated with illegal free downloads of the movie.

But as of October, many ISP subscribers can expect to receive noticed from the internet company of the UN4 Productions lawsuit complaint, its copyright infringement allegations, and notification of the right to file a motion to quash subpoena to oppose revealing the name and addresses of the subscriber to the movie company and its lawyer Greg Collins.

In addition, after the above these persons affected should expect to receive a settlement demand letter from attorney Gregory Collins to settle the claims out of court.   • ORDER granting Motion for Discovery signed by Judge David G Campbell on 9/13/2017

2:17-cv-02168-DGC UN4 Productions Incorporated v. Unknown Parties

  • Complaint was filed 07/06/2017
  • Judge Douglas L Rayes issued an order 09/13/2017 putting the fire under counsel for UN4 productions to timely serve the defendants.

Docket Text: ORDER that Plaintiff serve Defendants with the summons and complaint and file with the Clerk of the Court proof thereof pursuant to Rule 4(l), or otherwise show good cause for the failure to timely serve. FURTHER ORDERED that if Plaintiff fails to comply with this Order, the Clerk of Court shall dismiss this action after 10/10/2017, for Plaintiff’s lack of service pursuant to Rule 4(m). Signed by Judge Douglas L Rayes on 9/13/2017.

(emphasis added)

I expect the movie company may to file a motion for extension of time to serve the defendants, but have some doubt as to whether such a motion will be granted in this particular case given the above.

Charter internet subscriber files a motion to quash subpoena, but was denied.

“Doe No. 15 states that they did not watch, download, or distribute the movie at issue. The Court finds that the basis for Doe 15’s objection to the disclosure of the requested information is insufficient to quash the subpoena. Although the basis for the objection, if true, may preclude judgment against Doe 15, there is no indication that the discovery requested by Plaintiff asks for privileged information or subjects Doe 15 to undue burden. See Fed. R. Civ. P. 45(d)(3). For these reasons, Plaintiff’s Ex Parte Motion is GRANTED. Charter Communications is directed to disclose Doe 15’s identifying information in accordance with the Court’s June 16, 2017 Order.”

  • 08/23/2017 Magistrate Judge Debra McVicker Lynch granted the movie company’s Motion to Extend Time to Serve Defendants is granted. UN4 Productions granted to and including 11/20/2017 to serve Complaint.
