This Torrent Defenders® explainer is educational. It is not legal advice. Antonelli Law® defends people and businesses against copyright claims. We do not represent copyright holders. We do not invent a national 24-hour clock. A call is not a decision to go to trial. Most people who contact us want a quiet, confidential resolution. We also defend these cases in federal court when that is the better path.

If the letter is already on the table

Read the full case number and the deadline on the letter before you call anyone. An ISP letter is usually notice that the Internet provider (ISP) such as Spectrum or AT&T was ordered to identify an account. It is not a finding that you downloaded anything, and it is not the same document as a summons naming you.

The deadline on your letter is the one that matters, at least at first. It is often the date the ISP says is the last day to send them a motion to quash if you filed one in court. After that date, they can send your name and address at any time to the movie company attorney. Notices for an October 1 lawsuit filing usually arrive weeks later, not the day the case is opened.

Your ISP letter might describe the lawsuit with one of the following names: the civil action number, the docket number, or a case number. The important part is the number that looks something like 1:26-cv-01000.

What a Strike 3 Holdings lawsuit is

A Strike 3 Holdings Ohio case is usually a federal copyright complaint filed against a John Doe subscriber tied to an IP address, not against a person already named in the caption. Strike 3 Holdings, LLC is an adult-film company.

The lawsuits allege that someone in the home or business used BitTorrent software to obtain copies of their movies without paying for a license. The company then asks the court for permission to subpoena the internet provider for the account holder’s name and address.
