How is the Denver federal court handling Strike 3 Holdings cases?
The District of Colorado follows a consistent pattern in these cases:
- Referral to a magistrate judge. Within a few days of filing, the case is referred to a magistrate judge. In the cases we reviewed, Judge John L. Kane referred the case to Magistrate Judge Cyrus Y. Chung to handle pretrial matters.
- Fast early subpoenas. Strike 3 Holdings then asks for leave to serve a subpoena on the internet provider before the Rule 26(f) conference, under Federal Rule of Civil Procedure 26(d)(1). The court granted these motions “for good cause shown” within about one to eight days: May 12–14 for the May batch, June 3–8 and June 30–July 1 for the June batch, July 28 for the July batch, September 2 for the August batch, and September 30–October 2 for the September batch. The subpoena itself is issued under Rule 45.
- More time to serve. The court repeatedly extended Strike 3 Holdings’ deadline to serve the defendant under Rule 4(m), including on May 26 and 28, June 22, July 28, August 24 and 27, and September 16 and 18, 2026. One September 18 order set a new service deadline of November 14, 2026.
- An amended complaint. In 1:26-cv-01117, filed before the period began, Strike 3 Holdings filed an amended complaint on July 20, 2026, and a summons was issued the next day. On July 27 the court allowed the unredacted amended complaint, summons and return of service to be filed as restricted documents, so the name is not on the public docket. The court later extended the time to respond in that case on August 12.
- A dismissal. Strike 3 Holdings filed a notice of voluntary dismissal with prejudice in 1:26-cv-02699 on September 30, 2026, shortly after its service deadline had been extended.
Our docket searches for May 3 to November 2, 2026 found no orders to show cause, severance orders, sanctions orders, default judgments or motions to quash in Colorado Strike 3 Holdings cases. Only one Colorado amended complaint was filed in the period, and its unredacted version is restricted, so there is no amended complaint to post.
Which internet providers appear in the Colorado cases?
We reviewed the Exhibit A for the 10 Colorado cases filed on October 27, 2026 (1:26-cv-05553 through 1:26-cv-05570). Exhibit A is the document attached to the complaint that lists the IP address, the approximate location, the internet provider, and the works Strike 3 Holdings says were shared.
| Internet provider | Cases | Share | Our guide |
|---|---|---|---|
| CenturyLink | 6 | 60% | ISP letter guide |
| Comcast Cable (Xfinity) | 3 | 30% | Comcast Xfinity letters |
| Starry | 1 | 10% | ISP letter guide |
Source: Exhibit A to each complaint. The location and provider reflect the IP address, not a named person.
CenturyLink appeared in 6 of the 10 cases, Comcast Cable in 3 and Starry in 1. Exhibit A locations were Denver (7), Colorado Springs (2) and Parker (1). The number of works listed per case ranged from 24 to 100, with a median of about 40. See the Antonelli Law ISP subpoena defense page for more on each provider’s notice.

What does this mean if you received an ISP letter in Colorado?
A letter from your internet provider means the court has allowed Strike 3 Holdings to ask for the name and address on your account. It does not mean you have been found responsible for anything.
- Note the deadline. Your letter gives the date the provider plans to release your information. In Colorado the subpoena is usually approved within days of filing, so the letter can arrive soon after the case starts.
- Do not contact Strike 3 Holdings yourself. Anything you say can be used in the case.
- Do not ignore it. Our ISP letter guide, 2026 subpoena guide and guide on ignoring a subpoena walk through each step. Antonelli Law also explains motions to quash in BitTorrent cases and what happens if your ISP released your name.
