The Eastern District of New York federal judge wrote today:

the motion picture Mechanic: Resurrection [] was quite a good movie, (but I am a sucker for both Tommy Lee Jones and Jason Statham films, and this has both)”

ME2 Productions Memorandum on Default 17-cv-01196 NY

Judge Brian M. Cogan then awarded ME2 Productions a default judgment against the defendant in the amount of $10,000.

A number of defendants were dismissed without settling, so we are curious why ME2 Productions went so hard after this particular defendant. Maybe it was because ME2 Productions allegedly
sent him 16 cease and desist notices under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 1201 et seq.

As defense attorneys, we are concerned that people receiving a Waiver of Service of Summons form in the mail from the movie company’s lawyer will lead to an unfair default judgment against them. Each lawsuit is filed in federal court and requests permission to find out the real names of internet users associated with IP addresses suspected of being part of the movie downloading. This is done by sending a subpoena to the internet company (ISP). Most people find out they are involved in the lawsuit when they receive a letter from their internet company (ISP) such as Comcast, COX, Comcast, or Verizon informing them of the copyright infringement allegations. A copy of the Subpoena will probably be enclosed.

If you are the account holder for an internet service provider (ISP), your name is linked to an IP address.
