Malibu Media LLC Lawsuits Land Again in New Jersey

Malibu Media LLC, the copyright holder of pornographic videos produced for the X-Art.com subscription website, has again begun filing lawsuits against New Jersey residents after a 5 month absence. That absence was, no doubt, due to the notorious split between Malibu Media LLC and its outside general counsel.

On August 29th, Malibu Media LLC sued 24 unnamed defendants in New Jersey alleging they use BitTorrent or similar file-sharing software to download its copyrighted films in violation of the US Copyright Law. According to the complaints, they used IPP International and Excipio to obtain the needed evidence to make these allegations.

It is expected that Malibu Media’s attorney Patrick Cerillo will soon be filing motions with the court request permission to issue subpoenas to NJ residents’ ISPs to reveal their names and addresses.

This ISP letter and copy of the subpoena to your household will be the first indication that you are going to be served with a lawsuit. You should consult with an attorney immediately and prepare to either consider settling the lawsuit anonymously or prepare to fight the lawsuit in court.
