Malibu Media LLC Enters Texas – All Hat, No Cattle?

Malibu Media LLC, the copyright holder of erotic films website X-Art.com is perhaps the nation’s most litigious pornographer, whom BNA Bloomberg stated: “files up to 40% of  all copyright claims in U.S. federal court.” And now, it has entered the Southern District of Texas, filing 21 copyright infringement lawsuits in just the first few days of August alone (see below).

Malibu Media LLC says they want to stop people from illegally downloading their films, and they sue people in federal court alleging copyright infringement using BitTorrent or similar file-sharing software.

But critics of Malibu Media LLC  believe that when push comes to shove the alleged evidence of infringement is either so small that it cannot satisfy the elements of copyright infringement under the US Copyright Act, or that the technical allegations may not state a legal claim when you really get down to it. So, with all these new copyright infringement lawsuits being filed by Malibu Media LLC, it remains to be seen whether these cases are, or are not, a phenomenon best described as All Hat, No Cattle, The Emperor Has No Clothes, or perhaps that Malibu Media LLC can in fact win on the merits after all.
