Default Judgments in Cook Productions Case

The Ohio case of Cook Productions, LLC v. Hughes, et al, case number 3:16-cv-03045, shows the danger of not defending yourself in a movie downloading copyright infringement lawsuit.

Movie company Cook Productions, the company behind “Mr. Church” starring Eddie Murphy and Britt Robertson, is suing many internet users across the country. The company alleges its movie was obtained for free on the internet without paying its license fee. After filing the copyright infringement lawsuit in federal court, Cook Productions served subpoenas for the ISPs associated with IP addresses accused of participating in illegal downloads of the movie. The information sought by the subpoena was for the names and addresses of the persons who pay the internet bill. Then those persons were sued.

Unfortunately, not everyone who is sued hired an attorney or defended themselves in court. The result when this happens is called a default judgment, and that’s exactly what happened in a recent Ohio case for Cook Productions.

A number of defendants were served with Summons and then required to file responsive papers in court. Instead, according to the court docket, they failed to do so. on September 12, 2017 the Court entered the following order:

Default Judgment in favor of Cook Productions, LLC against Johnathan Toney, Krystal Ramsey each, in the amount of $13,347.50 ($12,000 in statutory damages and #1,347.50 in attorney fees) granting [41] Plaintiff’s Motion. A permanent injunction is also entered against Defendants Jonathan Toney and Krystal Ramsey, enjoining them from directly or indirectly infringing Plaintiff’s rights as noted in Order. Judge Jack Zouhary on 9/12/2017.

What Are These Lawsuits About?

Cook Productions accuses defendants of copyright infringement by using software such as BitTorrent and the internet to obtain the film “Mr. Church” without paying the appropriate license fee.
