Jeffrey Antonelli Quoted Regarding Strike 3 Holdings Florida Lawsuits

Strike 3 Holdings has been filing federal copyright infringement lawsuits for years, but more recently they’ve shifted their focus to filing their cases in Florida state courts. They have since received criticism for what many believe to be an improper use of Florida’s “pure bill of discovery” as well as improper filing as copyright infringement cases are federal cases.

In these cases, Strike 3 Holdings accuses defendants of illegally downloading their adult film content without the proper licensing fees, typically using a filesharing software such as BitTorrent.

Defendants usually first hear of the case in a letter from their internet service provider (ISP) and a subpoena from Strike 3 Holdings. The cases are time-sensitive and defendants risk losing their anonymity the longer they wait to act.

The problem with Strike 3 Holdings filing in Florida

Not only are copyright cases a federal matter, but many state courts aren’t used to them and there has been pushback. Antonelli notes that these cases don’t belong in state court and says in the motion:

“This Court lacks subject matter jurisdiction over the copyright claims at issue in the lawsuit which the subpoena to Comcast is premised upon. Federal courts have original and exclusive jurisdiction over civil actions arising under federal copyright law.”
