Have you received a subpoena from Malibu Media LLC?

In order to make an informed decision about your Malibu Media LLC case, it’s important to know all your options.

Who is Malibu Media LLC?

Malibu Media LLC is a company that produces adult films and distributes them through the website x-art.com.

If you’ve received a subpoena, they are alleging you illegally downloaded their adult films.

Your first notice of the lawsuit will probably be a notification letter from your internet service provider (ISP) and a subpoena from Malibu Media alleging that your IP address was used to download content online without the proper licensing fees.

Why am I being sued as John Doe?

The notification from your internet service provider (Comcast, Verizon, Cox, AT&T, etc.) is to inform you that Malibu Media is requesting your name.  Until they have your name, you are known on the subpoena anonymously as ‘John Doe’.

If Malibu Media receives your name, in almost all cases they will quickly amend the complaint name in the public court documents from ‘John Doe’ to your name—and then you will be served with a court summons.

Typically, once you have received this notice, you will have 30 days or less to determine how you want to handle the lawsuit.

Can I ignore a Malibu Media subpoena?

If you choose to ignore your subpoena, your internet service provider will likely release your name to Malibu Media’s lawyers.

In most cases, this will remove the ability to remain anonymous.

Some clients don’t mind losing their anonymity, but your options on how to handle your Malibu Media case will be limited after ignoring the subpoena and being served with a summons.

Under no circumstances should you ignore a summons.

What do I do now?

If you’ve received a Malibu Media LLC subpoena, you can handle your case in one of three ways:

  1. Anonymously settle the case.

People choose to anonymously settle for a variety of reasons, such as wanting to guarantee anonymity or perhaps simply to get everything dealt with as quickly as possible.

  1. File a motion to quash.

You can file a motion to quash your case before it goes to court. This only works in certain limited circumstances. Malibu Media can decide to file an amended lawsuit even if your motion is granted. To determine if this is a viable option for your case, discuss your circumstances with your ISP subpoena defense attorney.

  1. You can fight it.

If you believe you should not have received this subpoena, you can choose to fight Malibu Media in court. Antonelli Law will fight back vigorously on your behalf.

What our clients say:

Mr. Antonelli and his team were very patient and were more than willing to provide me and my family the information we needed to understand what a copyright suit was and what we should expect every step of the way. He gave us an understanding of all the potential avenues we could take to protect ourselves and explained what everything meant in layman’s terms.

He was always a phone call away and was usually very prompt emailing us back to keep us in the loop. Mr. Antonelli is very professional and felt like a part of the family who wanted to get the best outcome for us. He took the time to piece together a defense and counter the movie company’s claims for a reduced settlement well below what I have read is the norm.

There is a lot of misinformation out there on the internet and you need someone in your corner who has the experience and skill to get the best outcome for you and your family.

I cannot adequately explain how much relief his team provided during this scary time.
