Malibu Media LLC – Committed to California?

Malibu Media LLC  has continued filing its copyright infringement cases in California in late 2015, even as late as December 28th. We count a total of 139 California Malibu Media cases as of December 31st.

While it may have seemed natural for Malibu Media LLC to have begun filing cases in its own backyard (its owners live in Malibu), it is only in late 2015 that the lawsuits have come. Maybe this had something to do with Prenda.

If you are targeted by Malibu Media, the first you will learn of it will probably be by receiving a letter from your ISP. The letter will advise you of the right to file a motion to quash/motion to vacate the subpoena the ISP received. The subpoena commands the ISP to reveal your name to Malibu Media so they may serve you with a lawsuit. This is the time to prepare to either defend yourself in court, or to consider settling anonymously through an attorney. Or can also hire a lawyer to file a motion to proceed anonymously, so that you can fight an unfair lawsuit without worrying about having to settle to avoid being publicly named, at least in the beginning.
