United States District Court, Northern District of California Allows Subpoena to Proceed in Strike 3 Holdings, LLC v. Doe.

On March 11, 2019, The US District Court, N.D. California allowed Strike 3 Holdings to serve a subpoena on the internet service provider (ISP) AT&T, noting that Strike 3 Holdings had established that “good cause” exists to serve a third party subpoena.

This subpoena commands AT&T to provide Strike 3 Holdings with the true name and address of the Defendant, previously named as John Doe.

The court further ordered that the ISP has 30 days from the date of service to serve John Doe with a copy of the subpoena and the court order, and that the Defendant will then have 30 days from the date of service to file any motions in the court contesting the subpoena.

Have you been served with a Strike 3 Holdings subpoena?

Strike 3 Holdings has been aggressively filing copyright infringement lawsuits across the country. Strike 3 Holdings LLC is a company that distributes adult films through the subscription-based websites Blacked, Vixen, and Tushy.  If you’ve received a subpoena, Strike 3 Holdings is alleging that you (or someone in your home or office) downloaded their adult content without the proper licensing fees.

You have three options moving forward.

You can:

  • Come to an anonymous settlement
  • File a motion to quash in certain limited circumstances
  • Fight back in court

However, as you can see from the court order above, the longer you wait, the fewer options you’ll have to deal with your Strike 3 Holdings case.

Every defendant’s circumstances are different so it’s best to discuss your situation with an experienced ISP subpoena defense law firm, such as Antonelli Law.
