New Strike 3 Holdings Lawsuits in Eastern District of California: Magistrate Judge Delaney Issues Strong Privacy Protections — But Defendants Should Proceed with Extreme Caution at Any Informal Conference

Strike 3 Holdings, LLC has filed another wave of “John Doe” copyright lawsuits in the U.S. District Court for the Eastern District of California. These cases target individuals identified only by IP address, alleging illegal downloading and distribution of adult films via BitTorrent.

Key Protective Provisions in Judge Delaney’s Orders

These orders contain important safeguards, including:

  • Plaintiff is expressly cautioned that it may not reveal the defendant’s identity in or out of court without permission.
  • The subpoena to the ISP is limited to name and address only.
  • Attendance at any informal conference is voluntary and does not automatically constitute an appearance or waiver of service.

Most importantly, the orders explicitly state:

“Nothing in this order precludes plaintiff and defendant from reaching a settlement without court participation before any informal conference is held or formal service of process is effectuated.”

Important Warning for Anyone Considering an Informal Conference with Magistrate Judge Delaney

While these orders contain valuable protections, we strongly advise anyone who receives an ISP subpoena notice in these cases to think very carefully before voluntarily attending an informal conference with Magistrate Judge Delaney.

The order itself makes clear that one of the stated purposes of the conference is “To establish procedures for service of process or waiver thereof.”

During a voluntary conference, you may be asked — possibly with the plaintiff’s attorney present — whether you will waive service of process. More importantly, the order allows the case to be “resolved and a settlement placed on the record” during the conference. If you attend without your own attorney, you could face significant pressure to agree to a settlement on the spot.

Our strong recommendation: Hire an experienced federal copyright defense attorney first. Do not attend unrepresented. Have your own lawyer review any waiver of service and prepare any settlement agreement on your behalf.
