What happens if you ignore Strike 3 Holdings?

One of our most frequent questions is:

What if I ignore Strike 3 Holdings? What can happen?

Have you recently received a notice from your home or office internet provider (such as Comcast, AT&T, Verizon, CenturyLink, Charter, etc.) letting you know that Strike 3 Holdings LLC is requesting your information? Strike 3 Holdings LLC is accusing you (someone in your home or office that uses your IP address) of illegally downloading their adult film content without paying the proper licensing fees.

Essentially, you are being accused of copyright infringement, which can be made more embarrassing by the fact that it’s adult content.

When you first receive the notice from your ISP, you are still listed as John Doe and your information is not yet available to Strike 3 Holdings.

You may be wondering if you can ignore the Strike 3 Holdings notice, wondering if they are possibly bluffing to get you to sign something, or if they’ll go away if you don’t ‘easily’ give in.

The first thing to note is that this subpoena is real and should be dealt with in a timely manner.

Right now, you are known to the court only as John Doe. If you ignore the subpoena your internet service provider will likely release your name to Strike 3 Holdings LLC’s lawyers.

Once Strike 3 Holdings has your name, in almost all cases they will amend the complaint name in the public court documents from ‘John Doe’ to your name. You will then be served with a court summons.

Many clients don’t mind losing their anonymity, but the downside to ignoring your Strike 3 Holdings subpoena and receiving a summons is that your options moving forward are limited and you’ll lose some of your negotiating power.

If you ignore a summons, there’s a chance you’ll get a default judgment against you.

Since I shouldn’t ignore Strike 3 Holdings, what do I do now?

First, a few things you shouldn’t do.

  1. Don’t sign anything without having your own representation review the paperwork.
  2. Don’t delete anything- it can end up making your penalties worse

We recommend that you find an experienced ISP subpoena defense attorney to help you understand the specifics of your case and to walk you through your options.

Your options include:

  • Settling out of court
  • Filing a Motion to Quash
  • Fighting back in court
