Patch.com: Hundreds in NJ Sued for Downloading Smut

Pornography production companies, such as Strike 3 Holdings LLC and Malibu Media LLC, have been going after hundreds of New Jersey residents.

Strike 3 Holdings and Malibu Media are alleging that the New Jersey residents are downloading their pornographic content without paying for it.

According to this patch.com article, many people believe settling is better, even if innocent, to avoid the risk of exposure.

“Government employees, teachers, police officers and many others who are required to reveal legal trouble on job applications have been forced to settle rather than risk exposure to their family, friends and potential employers.”

A lawyer for Strike 3 Holdings defended the suits:

“Lincoln Bandlow, a lawyer with Fox Rothschild LLP that handles many of Strike 3 Holdings’ suits, also backed up what was revealed in the nj.com report but defended the company’s actions.

Bandlow said the settlement money represents a small fraction of Strike 3’s revenues. But he said that illegal downloading is a “massive problem for every content creator” that needs to be addressed.

‘This is just a massive theft of everybody’s’ copyright work,” he said. “It’s pretty straightforward.’”

This story is quoting an earlier article published on patch.com that wonders whether these lawsuits are extortion.

“Their M.O. is the same: Find alleged porn pirates on BitTorrent, file thousands of nearly-identical lawsuits and demand damages of at least $150,000. But the companies are eager to settle, often for $10,000 to $20,000, according to defense attorneys who have worked the cases.”

However, an attorney that has represented Malibu Media in New Jersey describes any description of the suits as extortion is “malarkey”. “People don’t settle because they fear being outed, he said, but because they are guilty, and the evidence is on their computer.”
