What is a Malibu Media Subpoena?

A Malibu Media lawsuit alleges that the defendant has illegally downloaded adult films that are distributed through Malibu Media’s subscription website, x-art.com, using BitTorrent software.

Malibu Media uses geolocation technology to track the IP addresses of users who illegally downloaded their adult content. Based on this, Malibu Media can ask for permission from a judge to request that user’s name and address from their ISP.

If you’ve received a notice of a Malibu lawsuit from your ISP, you are still anonymous and identified as “John Doe.” You typically have a period of thirty days or less to determine how you will respond.

Don’t panic as you still have several options available. More importantly don’t try to throw anything away or delete anything as it could only make the situation worse.

Your Malibu Media Case with Antonelli Law

You have three options available if you have received a Malibu Media Subpoena.

  1. Resolve anonymously: You can agree on a financial settlement before your ISP releases your name and resolve your case anonymously. If you settle through an attorney like Antonelli Law you are protected from any future copyright actions by the movie company for alleged download activity that occurred before the settlement date.
  2. Quash it: You can file a motion to quash the subpoena based on a lack of sufficient evidence. This option is viable in certain limited circumstances such as if the case was filed in a different jurisdiction from where you live. However even if you win the motion to quash it’s possible that the movie company will have the right to file an amended lawsuit against you.
  3. Fight it: You have the potential to win the case and get damages which can include legal fees. If you choose to fight it in court, it’s possible that you could lose your anonymity. If this is the right option for you, choose an experienced ISP subpoena defense firm like Antonelli law. This area of the law is fast-changing and we continuously follow the latest developments. We understand the complicated technology involved in these cases and represent cases nationwide.

We’re ready to represent you in your Malibu Media lawsuit.

Here’s what a client recently said about working with Antonelli Law:

Jeff’s firm was professional and prompt. They were knowledgeable and worked hard negotiating the issues and coming to an acceptable compromise. While I wish that the case had never occurred, Antonelli’s firm made it considerably more bearable.
