Dallas Buyers Club LLC Files Case in Connecticut

Share

On September 5, 2014, Dallas Buyers Club LLC filed two federal copyright lawsuits in Connecticut, targeting 56 unnamed Doe defendants. This may be a two-edged sword, as Connecticut has the highest per-capita income of the United States: the guilty are more likely to have collectible assets than, say, the average person in Mississippi; yet the innocent are also more likely to possess the financial wherewithal to fight back and not settle, potentially exposing Dallas Buyers Club LLC to having to pay defendants’ attorneys fees.

Eric Osterberg of Osterberg LLC is representing Dallas Buyers Club LLC. According to his biography, Osterberg has been practicing Intellectual Property law for more than 20 years. He is admitted to the federal courts in Connecticut, Massachusetts and both the Southern and Eastern Districts of New York. Whether people in these jurisdictions will be targeted in the future by Dallas Buyers Club LLC remains to be seen.

These are the new Dallas Buyers Club LLC lawsuits:

Connecticut

3:14-cv-01283-JBA Dallas Buyers Club LLC v. Does 1-29

Like each previous federal lawsuit filed by Dallas Buyers Club LLC, the company alleges these as-yet anonymous Doe defendants illegally downloaded the movie Dallas Buyers Club using BitTorrent or similar peer-to-peer file-sharing programs without paying the appropriate license fee.

If you receive a letter from your ISP notifying you it received a subpoena to reveal your identity relating to a Dallas Buyers Club LLC lawsuit, read our prior post Dallas Buyers Club lawsuits – How to Respond to an ISP Letter.

Its is not a good idea to download the Dallas Buyers Club movie using BitTorrent or similar software, especially in states like Connecticut where Dallas Buyers Club LLC is actively suing.  If you are a parent make sure your children are not doing this; if you have roommates make sure your roommates are not doing this, as being a target of a federal lawsuit like this over a movie download is not fun, not fair, and is avoidable.
