Dallas Buyers Club LLC Files Case in Connecticut

On September 5, 2014, Dallas Buyers Club LLC filed two federal copyright lawsuits in Connecticut, targeting 56 unnamed Doe defendants. This may be a two-edged sword, as Connecticut has the highest per-capita income of the United States: the guilty are more likely to have collectible assets than, say, the average person in Mississippi; yet the innocent are also more likely to possess the financial wherewithal to fight back and not settle, potentially exposing Dallas Buyers Club LLC to having to pay defendants’ attorneys fees.

Eric Osterberg of Osterberg LLC is representing Dallas Buyers Club LLC. According to his biography, Osterberg has been practicing Intellectual Property law for more than 20 years. He is admitted to the federal courts in Connecticut, Massachusetts and both the Southern and Eastern Districts of New York. Like each previous federal lawsuit filed by Dallas Buyers Club LLC, the company alleges these as-yet anonymous Doe defendants illegally downloaded the movie Dallas Buyers Club using BitTorrent or similar peer-to-peer file-sharing programs without paying the appropriate license fee.
