Antonelli Law Files a Motion to Quash Against Strike 3 Holdings LLC in New Jersey

Antonelli Law recently cited a decision against Strike 3 Holdings LLC from the United States District Court for the District of Columbia in a similar case in New Jersey. Strike 3 Holdings LLC had filed a lawsuit against an anonymous defendant (case number 2:18-cv-10619-KM-CLW) in New Jersey alleging the defendant had illegally downloaded Strike 3’s adult content using file-sharing software.

Antonelli Law cited Senior United States District Judge Lamberth’s memorandum regarding Strike 3 Holdings LLC v. John Doe subscriber (assigned IP address 73.180.154.14), to persuade a judge in New Jersey to grant a motion to quash.

Jeffrey Antonelli explains how one judge’s ruling can help other cases against Strike 3 Holdings LLC:

 “We used Judge Lamberth’s opinion in another case in New Jersey, where we filed a motion to quash. We challenged the case from the very beginning, before our client’s name was released, saying that there were a lot of questions with the filing. An interesting thing about that case is Strike 3’s attorneys threatened sanctions against Antonelli Law (through our local counsel) saying ‘how can you file this motion to quash?’ We responded with a number of things, including that there has been plenty of cases where judges have, in fact, denied Strike 3’s request to unmask the person behind the IP address.

We noted Judges Lamberth’s opinion for the court. The judge in New Jersey has turned around and issued what’s called a rule to show cause or order to show cause against Strike 3 asking why the court shouldn’t follow the DC judge’s ruling and dismiss the case.”

Strike 3 Holdings now has to show the New Jersey judge cause in order to have John Doe’s identity released.
