UPDATE: 52 Dallas Buyers Club LLC Defendants to Learn Their Fate

UPDATE: Attorneys for Dallas Buyers Club LLC have been granted  leave to file a Motion to File a Supplemental Memorandum.  Supplemental Memorandum to be filed by July 1 2014  and hearing date is reset to July 14 2014.

The case numbers are 14-cv-03504 and 14-cv-03517 in the Northern District of Illinois federal court.

On June 19th, 52 now-anonymous “John Doe” Defendants targeted in BitTorrent copyright lawsuits filed by Dallas Buyers Club, LLC   will find out if their cases will be “severed” by federal district judge Michael Kennelly of the Northern District of Illinois and therefore deny the request to subpoenas each defendant’s ISP for their identity to be provided to the plaintiff.

The case numbers are 14-cv-03504 and 14-cv-03517 in the Northern District of Illinois federal court.

Previously, a number of other judges on the same court in the Northern District of Illinois have allowed early discovery subpoenas to be sent to ISPs seeking the identities of groups of defendants targeted by the film’s copyright holder, which are known only by their IP addresses when the lawsuit is first filed. This includes federal judges John J. Tharp, Jr in 14-cv-03087, James B. Zagel in 14-cv-03083, Robert W. Gettleman in 14-cv-03082 and 14-cv-03521, Joan B. Gottschall in 14-cv-03080, Sharon Johnson Coleman in 14-cv-03511, Gary Feinerman in 14-cv-02302.

In contrast, judge John Z. Lee denied Dallas Buyers Club LLC’s motion for early discovery for all but one defendant’s ISP subpoena in 14-cv-03085, citing his “previously expressed substantial concerns regarding fairness and judicial economy where, as here, a plaintiff seeks to join twenty unrelated individual defendants.”  Similarly, judge Edmond E. Chang denied Dallas Buyers Club LLC’s motion for early discovery for all but one defendant’s ISP subpoena in 14-cv-2303.
