Strike 3 Holdings LLC Subpoenas in Connecticut to ISPs Allowed – ISP Subpoena Defense

Share

Strike 3 Holdings LLC , the movie company behind the adult entertainment brands Tushy, Vixen, and Blacked is suing internet users in California, Connecticut, New York, New Jersey, Michigan, and Pennsylvania  for using computer file-sharing software to obtain its movie for free.

Most recently, Strike 3 Holdings has obtained the permission of District of Connecticut courts to issue subpoenas to ISPs to learn the true names and addresses of subscribers it accuses of illegal downloads of its movies. Scroll below to view several of these court orders.

Strike 3 Holdings is conducting a strengthening national litigation campaign. The lawsuits in California, Pennsylvania, and New Jersey were filed by Fox Rothschild, an 800 attorney law firm not previously known to represent copyright holders in aggressive BitTorrent copyright infringement litigation.

The law firm representing Strike 3 Holdings LLC in New York and Connecticut – the James Law Firm PLLC – is smaller, run by attorney Jacqueline M. James and is well known for filing many BitTorrent copyright infringement lawsuits on behalf of Malibu Media LLC. Malibu Media was until recently the most prolific filer of copyright infringement lawsuits in the country. Antonelli Law has represented over 500 people sued by Malibu Media LLC all across the country, successfully resolving these claims through litigation and settlement negotiations where defendants were often accused of downloading over 100 copyrighted movies. The Malibu Media settlement demands arose to amounts of of up to $50,000 and statutory damage requests exceeding one million dollars. We anticipate that Strike 3 Holdings LLC may follow a similar pattern.

While Strike 3 Holdings lawsuits may have been filed by a capable law firm, their lawsuits suffer from the same weaknesses. Antonelli Law has discovered that the Strike 3 Holdings LLC lawsuits, like many other movie companies’ lawsuits, are afflicted with with technical weaknesses that some judges may hold are bad enough that the lawsuits may be thrown out. And if the lawsuits are bad enough to be thrown out, the subpoenas asking for the names of internet subscribers must be thrown out, too. This is called quashing the subpoena.

For example, Strike 3 Holdings LLC allegations state only that “a piece” of data from each movie was obtained by their investigator IPP. See for example the embedded Complaint below from the New Jersey lawsuit at Paragraph 25 in case number 17-cv-10285. A piece of data? When we are hired by a client, one of the questions we may present to the judge is “Is this even enough data to produce a flash of one image of the movie? If so this may qualify as a defense for what is called “de minimis” copyright infringement.” If this is established the movie company may be entitled to nothing. This is just one of many defenses and procedural attacks Antonelli Law defense attorneys can use in your courtroom defense or a settlement.

Why Did I Receive a Subpoena from Strike 3 Holdings LLC?

The Strike 3 Holdings LLC subpoena probably relates to a federal copyright infringement lawsuit. Essentially, Strike 3 Holdings LLC is alleging that someone in the home or office illegally downloaded movies from adult entertainment brands Tushy, Vixen, and Blacked using file-sharing software such as BitTorrent without paying a license fee. Doing so amounts to copyright infringement according to the movie company.

Antonelli Law’s BitTorrent Copyright Defense Group is the nation’s most experienced, offering affordable, competent defense services nationwide. We have helped nearly 2,000 clients from Hawaii to New York deal with ISP subpoenas and federal court copyright infringement lawsuit litigation. In fact, because we defended so many people from porn movie company Malibu Media LLC’s copyright infringement lawsuits – nearly 600 nationally – the firm’s President attorney Jeffrey Antonelli has been interviewed by Bloomberg BNA, NBC, Chicago Lawyer, and the longstanding lawyer’s publication Chicago Daily Law Bulletin

What Do I Do?
Firstly and most importantly- don’t ignore it! You have a limited amount of time to decide what to do; the longer you leave it, the fewer choices you’ll have. Typically, you have anywhere from two weeks to one month after receiving the ISP letter and Strike 3 Holdings LLC subpoena to decide what to do.

Secondly, deleting anything could make the penalties worse, don’t try to hide anything.

Don’t Sign Anything Before Speaking with a Copyright Defense Attorney
If you receive a Waiver of Service of Summons form in the mail, don’t sign it before speaking with an experienced attorney. Signing the Waiver of Service of Summons form you received in the mail from the movie company’s lawyer will in some cases lead to an unfair default or consent judgments against you.

Speaking with an experienced attorney with a background in ISP subpoena defense can help you make informed decisions about how to process. Antonelli Law provides free copyright infringement consultations to Internet users being sued by Strike 3 Holdings LLC.

If you want to read more about recent cases of ISP users in copyright infringement allegation lawsuits, consider this article by Jeffrey Antonelli about “copyright troll” litigation, published by the Illinois State Bar Association’s Intellectual Property Section. It speaks to our experience in this field of litigation.

Once you’ve spoken to an experienced ISP Subpoena Defense Attorney, you’ll understand your specific case better, but generally, you have three options:

Resolving Your Strike 3 Holdings LLC Case Anonymously
The easiest and most common way to resolve your Strike 3 Holdings LLC case is out of court. Choosing this option allows you to settle anonymously. At Antonelli Law, we charge a flat legal fee of between $1,500 – $2,000 for anonymous settlements depending on a number of factors of your particular case.. This includes not only the negotiation of the settlement amount, but effectively presenting the reasons why the movie company may have difficulty winning their case if it went to court. It also includes negotiating the terms of the settlement agreement, which we insist must not include any admissions of guilt. It also includes ensuring that that the ISP does not disclose your identity to the movie company lawyer (when available), and that the movie company actually files a proper notice of dismissal in court. Finally, we check the court docket for when the judge finally enters an order dismissing you from the case permanently by your Doe number and/or IP address. Then we accept your settlement payment from you into our law firm trust account. When the funds clear, we send our law firm trust account check to the movie company’s lawyer. This way you and your financial information stays anonymous.

Filing a Motion to Quash the Strike 3 Holdings LLC Subpoena You Received
The motion to quash argues that the lawsuit’s complaints claiming copyright infringement only claim a few ‘bits’ of data were transmitted by the IP address and user in question, therefore they do not provide enough evidence to make a claim on copyright infringement, and the court should throw out the copyright infringement lawsuit brought by Strike 3 Holdings LLC due to deficiency, then the court should also quash the subpoena for the user in question. At Antonelli Law, we offer a flat rate for filing motions to quash a subpoena.

This option is not without risks. Besides losing your anonymity in court, this defense is not often accepted by the court. Contact Antonelli’s experienced ISP subpoena defense lawyers to discuss this option further.

Preparing to Fight Your Strike 3 Holdings LLC Case in Court
When choosing to fight a copyright infringement lawsuit brought against you by Strike 3 Holdings LLC, for the illegal downloads of movies from adult entertainment brands Tushy, Vixen, and Blacked, Antonelli Law should be your first choice for defense.

We have local counsel coast to coast, to help us efficiently settle or fight lawsuits brought against our clients. We offer free consultations where we explain what you can expect when fighting this copyright infringement lawsuit from Strike 3 Holdings LLC in court. After that, we charge an hourly fee.

There are many defense standpoints from which we can tenaciously work to fight the copyright infringement lawsuit brought against California Internet users by Strike 3 Holdings LLC over the adult entertainment brands Tushy, Vixen, and Blacked. One of the most common forms of defense is claiming that the user who transmitted the data for movies from adult entertainment brands Tushy, Vixen, and Blacked through a BitTorrent is not the user at this IP address.

This is a strong defense because the copyright infringement lawsuit brought against the defendant assumes that the defendant used their own IP address to transmit the data for the movie. However, hackers often disguise their IP addresses when illegally transmitting data online, so in many cases, the defendant is not at fault and did not commit copyright infringement by downloading movies from adult entertainment brands Tushy, Vixen, and Blacked over a bit torrent.
