Judge Questions Joinder in ME2 Productions Inc Case in Chicago – Movie Download Lawsuit

ME2 Productions Inc. , the movie company holding the copyright to the movie  “Mechanic: Resurrection” starring Jessica Alba and Tommy Lee Jones, has filed a number of federal lawsuits in the Northern District of Illinois in Chicago alleging internet subscribers illegally downloaded its movie for free. The movie Mechanic: Resurrection’s plot includes rescuing Jessica Alba’s character who is kidnapped.

The lawsuits are premised on the US Copyright Act alleging copyright infringement through peer-to-peer file sharing.

In one of these lawsuits, on the same day it was filed Chicago based federal judge Edmond E. Chang issued an order in case number 1:17-cv-00706 ME2 Productions, Inc. v. Does 1-25 that questioned the joining of the 25 unnamed defendants together. Judge Chang ordered ME2 Productions, Inc. to file papers with the court as to why these 25 defendants should be joined:

This case was filed against 25 Doe Defendants, arising from the use of BitTorrent. But there is a question of improper joinder, when measured against the standard set by this Court’s opinion in reFX Audio Software v. Does 1-85, 2014 WL 1293816, at *5-6 (N.D. Ill. March 24, 2014) (Case Nos. 13 C 01790, 13 C 01793, 13 C 03524, 13 C 07494). On review of Exhibit B to the Complaint, it does not appear that Plaintiff picked Defendants for joinder based on the Opinion. Plaintiff may argue against the prior Opinion and move for a finding of proper joinder, but must do so by 02/13/2017 (if no new arguments have been fashioned since the last time this Plaintiff argued against the Opinion, it is unlikely that the motion will be granted). Alternatively, Plaintiff may file an amended complaint by 02/13/2017, to comply with the Opinion. To track the filing of the motion or an amended complaint, a status hearing is set for 02/22/2017 at 9:15 AM

As of today February 8 2017, ME2 productions, Inc has yet to file either its motion or an amended complaint.
