“Free” Movie Download Lawsuits by Cook Productions – Free Consultation With Antonelli Law Defense

Cook Productions Inc.  is accusing Hawaiian Telecom internet subscribers of copyright infringement for downloading the film “Mr. Church” without paying the license fee. The movie stars Eddie Murphy and Britt Robertson. The movie company has already filed lawsuits against hundreds of people in Colorado, Illinois, Indiana, North Carolina, and Oregon.

It should be noted that paying the bill for an internet account that is assigned an IP address that may be involved with an illegal movie download does NOT make that internet subscriber guilty of any wrongdoing.

In fact, federal judge Richard L. Puglisi of the District of Hawaii expressly stated the following in this Order  granting Cook Productions the right to issue a subpoena to Hawaiian Telecom for Cook Productions in January 2017:

“Although the information requested by Plaintiff may identify the subscriber associated with each IP address, that information will not necessarily reveal the person that allegedly infringed Plaintiff’s work.”

 “…it is no more likely that the subscriber to an IP address carried out a particular computer function . . . than to say an individual who pays the telephone bill made a specific telephone call.”  In re BitTorrent Adult Film Copyright Infringement Cases, 296 F.R.D. 80, 84 (E.D.N.Y. 2012).

What Are These Lawsuits About?

Critics of these lawsuits say its about the movie company generating more revenue. The movie company says it is filing these lawsuits to stop piracy of its intellectual property.
