Can I File a Motion to Quash the ISP Subpoena?

Yes, if it is not after the deadline to do so stated in your notice form your internet service provider. If the deadline has not passed, we would need to discuss with you the relative strengths and weaknesses of doing so. See this page from our law firm website on Motions to Quash a Subpoena.

Summons Issued for Arizona Alleged Downloaders of Fathers & Daughters Movie

Share

Fathers & Daughters Nevada LLC is trying to show it is serious. After filing its copyright lawsuit back in April 2016, the company – which alleges internet users illegally downloaded the copyright film “Fathers & Daughters”  – has finally issued summons and filed an amended complaint on October 14 2016.

Click here for a copy of the Amended Complaint

Some of the allegations are unusual. For example, the allegations against one named defendant states:

“Upon information and belief, Plaintiff is a married woman and her actions as alleged herein were taken on behalf of and as part of her marital community, which includes John Doe Massena.”

Aside from the obvious error of stating the defendant is the “Plaintiff” the allegations appear to be an oblique assertion that the wife downloaded the film as the agent of her husband. If the claim is litigated, it will be interesting to see how the court views these claims and if a motion to strike or similar procedural attack would be accepted by the court.

This is what clients say Antonelli Law is very good at:
  • Reducing your anxiety about the problem
  • Giving clear information to help you decide what to do
  • Responsive and accessible via phone and email
  • Tenacious and effective lawyers in lawsuit litigation

We understand the shock you may be feeling from receiving a notice of this action, and have the experience to help you deal with this in the best way possible for you: anonymous settlement, prepare to fight back, or other options. Attorney referrals accepted.

Attorneys: Don’t risk malpractice in a copyright lawsuit where the  loser pays statutory and attorneys fees.  If you usually handle divorce, real estate, or other non-IP matters these cases are not for you. We accept attorney referrals and are very experienced in this specialized litigation.
