In Utah, an Alarming Trend of Consent Judgments

But in Utah, an alarming trend is developing in ME2 Productions lawsuits. People unrepresented by attorneys are agreeing to stipulated consent judgments where they apparently admit to downloading the movie and admit to liability for copyright infringement.

• LHF Productions v. Does 1-27 2:16-cv-01219-DBP four defendants agreed to a consent judgment against themselves.
• LHF Productions v Does 1-27 2:16-cv-01262-DN-DBP, three defendants agreed to a consent judgment against themselves.
• LHF Productions v. Does 1-282:16-cv-1238-DBP two defendants agreed to a consent judgment against themselves.
• LHF Productions v Does 1-22 2:16-cv-01099-DBP one defendant agreed to a consent judgment against themselves
• roductions v. Does 1-21 2:17-cv-00016 one defendant has agreed to a consent judgment against themselves.

Please note that we did not personally review each consent order. There may be differences we have not noticed. See the next paragraph for one example of a difference in consent judgments we did notice.

On One Day Two Consent Judgments Were Entered – One With, and One Without, being Represented By an Attorney

In one stipulated consent order we reviewed in a LHF Productions lawsuit where the John Doe Defendant was represented by an attorney, the stipulation stated that the defendant denied all claims of liability, but he did consent to a permanent injunction against it.

In the same case on the same day, where a named defendant was not represented by an attorney, that second defendant’s stipulated consent judgment did admit to liability for copyright infringement. The case is LHF Productions v. Does 1-27 2:16-cv-01219-DBP. Compare docket entry 14 with docket entry 15.

So What’s the Danger of a Consent Judgment?

In our opinion, it is very dangerous for an individual to agree to a consent judgment admitting to copyright infringement in a LHF Productions lawsuit. The reason is the following:

If the person who entered into a consent judgment in the first case is ever accused in the future of illegal downloading of a copyrighted movie, song, or software program, the plaintiff in that second case can argue that since the defendant already admitted once in court to committing copyright infringement the second case should result in willful copyright infringement statutory damages, i.e. $30,000 or more.

It is not uncommon for individuals to be accused more than once of illegal movie downloads. Even if they are innocent.

Background: The LHF Productions Inc Lawsuit

LHF Productions, Inc. the copyright holder of the movie  “London Has Fallen” starring Gerard Butler, Morgan Freeman and Aaron Eckhart, has begun suing Utah Comcast and Centurylink users for allegedly downloading the movie for free.
