ME2 Productions Inc Sues Ohio Internet Users – But Do They Have Enough Evidence? Antonelli Law Defense & Information

ME2 Productions Inc. , the copyright holder of the movie  “Mechanic: Resurrection” starring Jason Statham, Jessica Alba, and Tommy Lee Jones is suing internet subscribers in Ohio federal court (and in other states) alleging they illegally downloaded the movie for free.

While it is undisputed that internet piracy is a large problem for copyright holders, innocent people are being targeted in free movie download lawsuits because the data can be wrong, and paying the internet bill does not mean you illegally downloaded the movie for free.

Does ME2 Productions Inc. Have Enough Data to Prove Its Claims?

In many free movie lawsuits, the movie company alleges that its agents obtained data from the alleged IP address of the defendant in what is called a BitTorrent “swarm” – which is one way people download large files.

But how much data is enough for a legally sufficient lawsuit complaint? In some cases, these lawsuits can be challenged because the Plaintiff must show:

  1. It has ownership of a valid copyright and
  2. The defendant violated the copyright owner’s exclusive rights under the Copyright Act.

In one case Antonelli Law is defending (a different movie than the one here), the Defendant contends that Plaintiff has not alleged significant evidence to show that any of its copyrighted materials were violated. The movie company submitted a declaration of its agent (not the same as the company in this article) stating that “multiple bits were conveyed over [the] connection.” However, we argue, multiple “bits” of data do not translate to a viewable image close enough to approximate being substantially similar to the movie company’s copyrighted work.

As Law Professor Matthew Sag states in his recent article “Defense Against the Dark Arts of Copyright Trolling”:

“the isolated “bits” of the movie that [Plaintiff] supposedly received from the defendant’s IP address do not meet the standard for copyright infringement. In the cases that we have studied, the plaintiffs have offered declarations that defendant’s IP address was observed transmitting data with a certain hash value. That hash value, it is alleged, is the same as the hash value of a piece that the witness combined with other pieces to create a file identical to the copyright owner’s work… note that these declarations say nothing about the size or contents of the portions of the work actually downloaded from the defendant’s IP address. In essence, the plaintiff can only state truthfully that its software observed the defendant’s IP address transmitting a fraction of the work….”There is nothing in either declaration that would allow the court to conclude that the “bits” and “pieces” captured by [plaintiff’s experts’] technology as allegedly distributed from Doe’s IP address meet the standard of originality justifying a finding that they are protectable elements of the works.

So How Much Data Did ME2 Productions Allegedly Observe From Defendants?

In at least one ME2 Productions case, the movie company filed an declaration of Daniel Arheidt, working as a consultant for Maverickeye UG of Germany. That declaration appears to merely say that the Maverick Monitor software works by directly connecting with the computer at each IP address and downloading “a portion” of the infringing file.

Are these allegations enough to withstand a motion to dismiss the Complaint? A defendant will need to ask the judge to make that determination. It may cost more to do this than to settle, but this could be the right strategy for some who are targeted in ME2 Productions lawsuits.

We also noticed that in the Ohio case ME2 Productions, Inc. v Does 1-8 17-cv-00342 it appears ME2 Productions Inc forgot to include the declaration of Daniel Arheidt, though its motion for early discovery (to subpoena the ISP for subscriber’s identities) repeatedly makes reference to his declaration. While this could be corrected, as it stands a defense attorney can make a compelling case that subpoena must be quashed due to the Complaint’s failure to state a claim under federal rule 12(b)(6).

ME2 Productions Inc. , the movie company holding the copyright to the movie  “Mechanic: Resurrection” starring Jessica Alba and Tommy Lee Jones, has filed a staggering number of federal lawsuits in the Northern District of Illinois in Chicago alleging more than 600 internet subscribers illegally downloaded its movie for free.

The movie Mechanic: Resurrection’s plot includes rescuing Jessica Alba’s character who is kidnapped.

WWE Studios is Suing for Alleged Illegal Movie Downloads of the Movie “THE ELIMINATORS”

WWE Studios Finance Corporation is suing internet account-holders in Hawaii, Nevada, Pennsylvania, and Connecticut alleging they downloaded the movie “The Eliminators” without a license to do so. Based on the fast spreading of lawsuits from just Oregon initially last fall, to four more states in just two months, we believe it is likely that many more lawsuits may follow.

What Do The Lawsuits Allege?

The lawsuits allege “The Eliminators” was obtained illegally for free using file-sharing technology known as BitTorrent, although software and apps named something else may also use this technology. See this article from Torrent Freak about the lawsuits.

The copyright form for the movie lists WWE Studios Finance Corporation as the copyright claimant, and lists World Wrestling Entertainment, Inc. (“WWE”) of Wrestlemania fame as the contact for rights and permissions.  A few websites WWE Studios Finance Corporation mentions as aiding in the illegal file-sharing are www.TorrentZap.com, www.Btscene.com, and www.ExtraTorrent.com.

What is the Legal Basis for the Lawsuits?

The lawsuits are based in copyright, and the company asks the court to award it monetary damages, attorneys fees, and an injunction to stop the defendants from using or sharing its copyrighted movie.

WWE Studios Finance Corporation states in these lawsuits that it used a computer company called MaverickEye UG to obtain the computer IP addresses that were involved ion these downloads. Questionable Claims for Vicarious Copyright Infringement

In the Nevada lawsuits filed by WWE Studios Finance Corporation, in addition to claims of direct and contributory copyright infringement, the movie company makes a third, and in our opinion questionable, claim for “vicarious copyright infringement.” We do not know of any case law that would support the claim as stated, which reads in part:

“Each of the Defendants failed to reasonably supervise the use of their respective Internet access points, thereby allowing those Internet access points to be utilized for the purposes of unlawfully downloading and sharing the Plaintiff’s Work. “

If WWE Studios has judicial legal authority for such claims of what sound like negligence in failure to supervise (rather than knowing and approving of third parties using their internet access to commit copyright infringement) we would like to see it.

Connecticut Judge Orders Rule to Show Cause

In the Connecticut lawsuit, WWE Studios Finance Corporation v Does 1-14 17-cv-00572, District of Connecticut judge Jeffrey A. Meyer issued the following order on April 7th questioning why WWE Studios joined numerous defendants together in the same lawsuit.

The Order states:

ORDER TO SHOW CAUSE WHY ALL DEFENDANTS OTHER THAN A SINGLE JOHN DOE DEFENDANT SHOULD NOT BE DISMISSED FOR LACK OF PROPER JOINDER. Plaintiff has filed this action against numerous “John Doe” defendants. In light of the concerns set forth in ME2 Productions v. Does 1-4, 2016 WL 6948333 (N.D. Ga. 2016), plaintiff shall file a memorandum of law on or before April 21, 2017, explaining why all remaining defendants other than a single John Doe defendant should not be dismissed for lack of proper joinder in this action

The fact that Judge Meyer issued this ruling on his own just one day after the lawsuit was filed is telling. It may signal increased judicial skepticism of these types of lawsuits.

We Do File Motions to Quash Movie Downloading Subpoenas (But only rarely – ready why)

You’re a target of a movie downloading lawsuit. Your first notification will be from your internet company (like Comcast). The notice will tell you the movie company subpoenaed it to release your name and address. The subpoena from ME2 Productions, Malibu Media LLC, Cook Productions, etc is usually subject to your filing a motion to quash (or vacate) the subpoena in the federal court that the copyright infringement lawsuit was filed in.

Antonelli Law has defended nearly 2,000 people across the country during the last 5 years in move downloading lawsuits. How many times have we filed a motion to quash a subpoena? Probably less than a dozen. Why so few times? As explained in our Motions to Quash page on our law firm website, we felt that most of the time the motions to quash failed to resolve the case and get rid of the client’s problem – even if the motion to quash was a winner.

But sometimes we think it is best thing to do. Last week we filed a motion to quash in federal court with several bases (not all are stated here):

  1. The client was in a different state than the federal court where the lawsuit was filed, and therefore the court lacked jurisdiction over the internet account holder.
  2. The lawsuit’s complaint alleging copyright infringement really only alleged that a few “bits” of data were directly observed transmitted with the IP address in question. That’s not enough to make out a copyright infringement claim. Therefore, if the court should throw out the lawsuit’s complaint, it should quash the subpoena.

We wait to see what the judge’s decision will be. One judge’s decision in the trial court is not binding on any other judge, so whatever the decision is in our case it could be very different in yours. But if we win the motion, it just may encourage us (and our clients) to file more motions to quash the subpoena.
