Malibu Media LLC Files New Lawsuits after Three Month Hiatus

Malibu Media LLC recently filed new lawsuits against internet subscribers in New York, Connecticut and California. Malibu Media filed cases against 21 subscribers in the Southern District of New York and 11 subscribers in the District of Connecticut. Malibu is represented by their local counsel Jackie James in both New York and Connecticut.  In California, Malibu Media filed cases against 31 subscribers through their new counsel, the Pillar Law Group.

Before these recent lawsuits, Malibu Media LLC had not filed a new lawsuit against an internet subscriber for more than 90 days. These new lawsuits lay to rest the notion that Malibu Media LLC is stopping its nationwide litigation against account holders and new lawsuits may be filed in other states soon.

The recent lawsuits accuse the internet subscribers of illegally obtaining copies of Malibu Media’s copyrighted works using BitTorrent. Criminal Productions, Inc. Going After Century Link Subscribers in Colorado Springs, Colorado

Criminal Productions, Inc., the purported copyright holder to the movie “Criminal” is going after Century Link internet subscribers in Colorado Springs and a Comcast Cable internet subscriber in Littleton for allegedly downloading the movie without permission in violation of the US Copyright Act.  The case is Criminal Productions, Inc. v. Does 1-13 16-cv-01836-WYD-MEH.

On July 19th, Criminal Productions, Inc filed a motion with the court to expedite the discovery of the names of those persons who pay the internet bill so that the internet subscribers may be named and served with the lawsuit.

In the lawsuit’s Complaint, Criminal Productions, Inc. alleges that 13 unnamed defendants downloaded the BitTorrent file to obtain the movie, via a file named “Criminal.2016.TS.XviD-VAiN” according to the motion to expedite discovery. The motion includes a declaration in support  signed by Daniel Macek of Maverickeye UG of Germany. Note: Criminal Productions, Inc., alleges the Century Link internet subscribers used μTorrent 3.4.7, and the Comcast Cable subscriber in Littleton used libtorrent 1.0.0.

In late June 2016, LHF Productions filed 12 new copyright lawsuits in the Northern District Court of Illinois against 315 defendants with each defendant being an unnamed “Doe.”

On July 19 and 20th 2016, LHF Productions, Inc. filed motions before ten federal judges in the Northern District of Illinois requesting permission to issue subpoenas to Comcast Cable to reveal the identities of internet subscribers who allegedly downloaded the movie “London Has Fallen” without permission using BitTorrent.

LHF Productions, Inc. Lawsuit Granted Court Order to issue ISP Subpoenas in Colorado

Colorado Comcast internet subscribers will soon be receiving ISP letters informing them a subpoena was received to reveal their identity in a lawsuit filed by LHF Productions, Inc. These Comcast subscribers live in Arvada, Aurora, Brighton, Colorado Springs, Denver, Lafayette, Longmont, Westminster, and Wheat Ridge.  Click here for the IP addresses of these Comcast subscribers. 

On July 19, 2016 Colorado district judge Michael E. Hegarty granted LHF Productions, Inc.’s  request for early discovery and to issue subpoenas to internet Service Providers (ISPs) to reveal the identities of certain subscribers who are alleged to have illegally downloaded the movie “London Has Fallen.” The order is based in part on the declaration of Daniel Arheidt of Maverickeye UG of Germany attesting to what he says is the accurate movie, date, time, and hash value in the evidence logs compiled by the company’s software called “MaverickMonitor.”  See motion for leave to issue Comcast subpoenas.
