Malibu Media LLC – Committed to California?

Malibu Media LLC  has continued filing its copyright infringement cases in California in late 2015, even as late as December 28th. We count a total of 139 California Malibu Media cases as of December 31st.

While it may have seemed natural for Malibu Media LLC to have begun filing cases in its own backyard (its owners live in Malibu), it is only in late 2015 that the lawsuits have come. Maybe this had something to do with Prenda.

If you are targeted by Malibu Media, the first you will learn of it will probably be by receiving a letter from your ISP. The letter will advise you of the right to file a motion to quash/motion to vacate the subpoena the ISP received. The subpoena commands the ISP to reveal your name to Malibu Media so they may serve you with a lawsuit. This is the time to prepare to either defend yourself in court, or to consider settling anonymously through an attorney. Or can also hire a lawyer to file a motion to proceed anonymously, so that you can fight an unfair lawsuit without worrying about having to settle to avoid being publicly named, at least in the beginning.

Illinois Cobbler Nevada ISP Letters Arriving

Letters are arriving addressed to ISP subscribers in the Northern District of Illinois for copyright lawsuits filed by Cobbler Nevada LLC. These lawsuits against 353 “John Doe” defendants were filed in September 2015 and allege that the defendants illegally used BitTorrent or similar file-sharing software to download the movie “The Cobbler.”

The Pirate Bay – Down Forever?

Today, TorrentFreak reports “The Pirate Bay lost all of its active “Hydra” domain names this morning. ThePirateBay.LA, .GD, .MN and .VG were suspended by their registrar, alongside several other TPB related domains. The domain troubles make the site hard to reach through the usual channels, but The Pirate Bay still has some backups in reserve. ”

For the uninitiated, The Pirate Bay has been a source of obtaining free copies of artistic work, many copyrighted, by obtaining magnet links for using peer-to-peer (P2P) file-sharing software including BitTorrent.

So, is The Pirate Bay down forever? And if The Pirate Bay is lost forever, will digital piracy stop at least in terms of the scale we have seen the last several years?

We have seen past attempts to shut down The Pirate Bay.  It remains to be seen if this newest tactic, registration suspension, is more effective.

Another New Copyright Troll in Illinois: Torn Pictures Production Ltd.

Torn Pictures Production Ltd. has filed federal copyright infringement lawsuits involving the film titled “Rise of the Krays.” The film was directed by Zackary Adler and features Mark Preston, Nicola Stapleton and Simon Cotton. The film about two brothers starting the British Mafia is scheduled to be released in theaters in February 2016.

To date, Torn Pictures Production Ltd. has only filed lawsuits in Illinois. Five multiple Doe cases were filed in Illinois in December, targeting 124 total Does. The company is represented by Attorney Michael Hierl. This attorney has previously represented a number of other copyright holders including Dallas Buyers Club LLC, Cobbler Nevada LLC and Glacier Films Inc.

Like other BitTorrent peer-to-peer file-sharing cases, Torn Pictures Production Ltd. accuses defendants of copyright infringement by using software and the internet to obtain the film “Rise of the Krays” without paying the appropriate license fee.

2015 Year In Review: Malibu Media LLC

This year has been no different than the last for Malibu Media LLC, widely believed to be the most prolific filer of copyright lawsuits in the United States federal court system . They continue to file more copyright infringement lawsuits than any other company focusing on single John Doe defendants and they have remained active in a number of jurisdictions. For this year, 2015, they added California to their panoply of enforcement targets, after having a silent 2014.

New York and New Jersey top this list of busiest jurisdictions with 273 cases and 263 cases filed respectively. Illinois and Ohio were close behind, both having more than 200 John Doe defendants targeted. Florida was the quietest of this group with only 19 cases filed in 2015.

A few states got lucky and did not see any Malibu Media cases filed in 2015 even though they had in 2014. Residents of Colorado, Indiana and Wisconsin were breathing a little easier this year but it is hard to say what the future holds for these states.

In all, this year has seen lawsuits from Malibu Media in 11 jurisdictions against a total of 1,718 John Doe defendants. (That number could continue to rise in the remaining weeks of 2015.) They filed lawsuits in the previous year in 10 of these jurisdictions: Washington D.C., Florida, Illinois, Maryland, Michigan, New Jersey, New York, Ohio, Pennsylvania and Virginia.

Individuals in all states should be especially cautious when using BitTorrent to download, especially states in which Malibu Media has been active in the past. Hawaii, Massachusetts, Oregon, Texas and Washington are states that have experienced lawsuits from various other copyright trolls, but not Malibu Media. They too could easily be targeted by this company in the future.
