Malibu Media LLC Turns Up the Heat in Ohio and Maryland

Share

In June we reported that Malibu Media LLC had begun to test the waters in the Northern District of Ohio, and Ohio has been heating up. Since May of this year, Malibu Media LLC has filed approximately 207 new BitTorrent copyright lawsuits in the federal courts of Ohio, all through its local counsel Yousef Faroniya. Six were filed in the last two days.

However, the bigger if not unexpected story is that since the three judge panel in the Maryland District Court denied all of one defense counsel’s motions to consolidate and stay the pending Malibu Media cases on September 18th, Malibu Media LLC filed a set of 17 new BitTorrent copyright lawsuits in Maryland through its local counsel Jon Hoppe. We’re surprised it didn’t happen even sooner.

It is not a good idea to download the Malibu Media (X-Art.com) movies using BitTorrent or similar software.  If you are a parent make sure your children are not doing this; if you have roommates make sure your roommates are not doing this, as being a target of a federal lawsuit like this over a movie download is not fun, not fair, and is avoidable.

Countryman Nevada LLC – Not Done Yet

Share

Countryman Nevada LLC, a copyright plaintiff active in the early part of 2014, has shown  it isn’t quite ready to go away just yet.

A new case against 11 John Doe defendants was filed in Colorado, a jurisdiction that hasn’t seen any action from this copyright holder since June. John Doe defendants have been targeted in Florida, Illinois, Indiana and Michigan. However, none of these jurisdictions have been active since March.

The new case is Countryman Nevada LLC v. Does 1-11 14-cv-02832

Like each previous federal lawsuit filed by Countryman Nevada LLC, the company alleges these as-yet anonymous Doe defendants illegally downloaded the movie “Charlie Countryman” using BitTorrent or similar peer-to-peer file-sharing programs without paying the appropriate license fee.

To date, this company has filed 30 total cases against 641 John Doe defendants. The largest numbers of cases have been filed in Colorado and Illinois, accounting for over 90% of the defendants.

It is not a good idea to download the “Charlie Countryman” movie using BitTorrent or similar software.  If you are a parent make sure your children are not doing this; if you have roommates make sure your roommates are not doing this, as being a target of a federal lawsuit like this over a movie download is not fun, not fair, and is avoidable.

Attorney Jeffrey Antonelli is admitted to all federal courts of Indiana, Wisconsin, Michigan, Colorado, and the Northern and Central Districts of Illinois and can represent clients in any federal court anywhere through pro hac vice.
