UPDATE: 52 Dallas Buyers Club LLC Defendants to Learn Their Fate

UPDATE: Attorneys for Dallas Buyers Club LLC have been granted  leave to file a Motion to File a Supplemental Memorandum.  Supplemental Memorandum to be filed by July 1 2014  and hearing date is reset to July 14 2014.

The case numbers are 14-cv-03504 and 14-cv-03517 in the Northern District of Illinois federal court.

On June 19th, 52 now-anonymous “John Doe” Defendants targeted in BitTorrent copyright lawsuits filed by Dallas Buyers Club, LLC   will find out if their cases will be “severed” by federal district judge Michael Kennelly of the Northern District of Illinois and therefore deny the request to subpoenas each defendant’s ISP for their identity to be provided to the plaintiff.

The case numbers are 14-cv-03504 and 14-cv-03517 in the Northern District of Illinois federal court.

Previously, a number of other judges on the same court in the Northern District of Illinois have allowed early discovery subpoenas to be sent to ISPs seeking the identities of groups of defendants targeted by the film’s copyright holder, which are known only by their IP addresses when the lawsuit is first filed. This includes federal judges John J. Tharp, Jr in 14-cv-03087, James B. Zagel in 14-cv-03083, Robert W. Gettleman in 14-cv-03082 and 14-cv-03521, Joan B. Gottschall in 14-cv-03080, Sharon Johnson Coleman in 14-cv-03511, Gary Feinerman in 14-cv-02302.

In contrast, judge John Z. Lee denied Dallas Buyers Club LLC’s motion for early discovery for all but one defendant’s ISP subpoena in 14-cv-03085, citing his “previously expressed substantial concerns regarding fairness and judicial economy where, as here, a plaintiff seeks to join twenty unrelated individual defendants.”  Similarly, judge Edmond E. Chang denied Dallas Buyers Club LLC’s motion for early discovery for all but one defendant’s ISP subpoena in 14-cv-2303.

Malibu Media Tests Northern District of Ohio Waters

In late June 2014, Malibu Media LLC entered the waters in Northern District of Ohio filing 16 new copyright infringement lawsuits. The Northern District of Ohio (NDOH) has seemed somewhat hostile to copyright trolls.

For example, one federal judge, James S. Gwin,  sua sponte severed and dismissed all 197 doe defendants in four consolidated cases involving Safety Point Products in 2013 (1:12-cv-02812, 1:12-CV-2820, 1:12-CV-2831, 1:12-CV-2894).  The court expressed concern with respect to the business model of copyright trolling as few cases were litigated in the past, the fairness of applying “joinder” to these defendants, and the fact that plaintiff had escaped paying over $60,000 in filing fees by attempting to join these many defendants in just four separate lawsuits.

These new Malibu Media LLC lawsuits accuse defendants of using BitTorrent and the internet to illegally obtain their adult movies (originating from the X-Art website) without paying for a license and thus violating the US Copyright Act.

The same federal judge who dismissed all 197 doe defendants in the Safety Point litigation mentioned above, James S. Gwin, has been assigned three of these new Malibu Media lawsuits, 1:14-cv-01389,  1:14-cv-01390, and 1:14-cv-01426. It will be interesting to see how judge Gwin and the other Northern District of Ohio judges evaluate Malibu Media’s claims of accurately naming its defendants.

Dallas Buyers Club Sues Again in Colorado

On June 25 2014, Dallas Buyers Club LLC filed yet another federal copyright lawsuit in Colorado District Court, this time against 20  Doe defendants.

Dallas Buyers Club LLC alleges these as-yet anonymous Doe defendants illegally downloaded the movie Dallas Buyers Club using BitTorrent or similar peer-to-peer file-sharing programs without paying the appropriate license fee.

This newest lawsuit, Dallas Buyers Club LLC v Does 1-20 14-cv-01773 inches the national litigation campaign closer to the 2000 defendant mark.

Countryman Nevada LLC Shows Committment to Colorado with Lawsuit Number 10

Countryman Nevada LLC, filed it’s 10th multiple-defendant lawsuit on June 19, 2014, Countryman Nevada LLC v. Does 1-10 14-cv-01716 in the District Court of Colorado.

This brings the total number of defendants targeted by Countryman Nevada LLC nationwide to 562.

Countryman Nevada LLC alleges the defendants used BitTorrent peer-to-peer file-sharing software and the internet to obtain the film “Charlie Countryman” without paying the appropriate license fee. Countryman Nevada, LLC is represented in Colorado by attorney Scott Kannady, and in Illinois by attorneys Michael Hierl and Todd Parkhurst.
